Information about the transfers/exchange of land

The transfer/exchange of land is by two ways as :

Unregistered Transfer /exchange:

If both the parties are having consent with each other regarding the transfer of land ,in that case the parties, after writing " agreement of transfer” come to the area patwari for entering the mutation the patwari enters the same in the register and will present the same before the revenue officer of area who further after taking the statement of concerned parties, the mutation by virtue of unregistered transfer is hereby accepted.

Registered Transfer /exchange :

The registered transfer deed of land is made by the parties in the condition when the land of one party falls in the boundary limit of Municipal committee or Municipal Corporation and the land of other party falls in rural area. The rate of stamp duty will be charged on the value of land which is having more value than other land under exchange,whether it is urban or rural land/property. The patwari enters the mutation by virtue of registered exchange deed and presents before the area revenue officer and after listening to both the parties the exchange mutation is accepted.

List of date-bound works

As per the instructions mentioned in Punjab Land Record Manual, the work to be done by the officers/employees of revenue department is time bound work In the column 1 to 4, the detail of monthly work is given but as the list is so long hence the detail of stipulated period of specific work is given below :

Registry paper

The registry papers by the Registry officer are sent twice in a month to the Tehsildar and the patwari after entering the mutation , sent back to the tehsil office within a month through area kanoongo.

Mutation

Mutation is done by the patwari within one month of receiving the registered documents. The area revenue officers have to take decision on these without disputed mutations within 3 months. The ancestral mutations are entered by the patwari through chowkidar register and the area revenue officer must give decision within three months. The disputed mutations will be decided by the Sub Divisional Magistrate or Asstt. Collector Grade I within 6 months.

Revenue records/jamabandi

There same is prepared after a period of five years and the jamabandi prefpared after five years consists the implementation of mutations of last 5 years upto 15th of June of that year.

Entry of revenue record in the tehsil office "

The same must be deposited in the Tehsil Office upto 7th of September.

Entry in Sadar office/head office

The same are deposited in sadar office upto 30th of April.

Inspection of revenue record.

Before depositing ion tehsil, the girdawar/kanoongo make initial inspection and in the months of Sept. the kanoongo makes its inspection. The inspection and final verification by the area revenue officer is made before 30th of April.

Removal of mistakes/Fard Badar

During preparation of revenue record, while taking record from last revenue record, if there is any minor clerical mistake then through fard badar it can be got corrected.

Corrections in girdawari/cultivation record

If the cultivation of any person is changed by mistake the he will present the application with copy of revenue record/cultivation record to the area revenue officer by affixing court fee of Rs. 1.25.

Detail of revenue records etc./Dhal Bachh

As per the instructions in para 3.21 of Punjab Land Record Manual, the revenue records etc. are prepared every year by the patwari, village wise,. After the girdawari/cultivation record of rainy every year and after winter girdawari,the changes are made as per need . The details of revenue/excess revenue/local rates/surcharge of every cultivator and if any person wants to get the detail of his share of revenues etc. are also given in the same .

Demarcation

For the demarcation of boundaries of land, one application on pucca paper in two copies is given to the area revenue officer and its one copy, after entering in the register, the area revenue officer will send to the concerned girdawar/kanoongo and it will be his duty to give the demarcation on the spot within one month. The area revenue officer will give date to the applicant to present before him so as to know whether the work is completed or not and the applicant may inform him on that date. The revenue officer will make it sure that there should not be more than two presence of the applicant in this regard. The revenue officer will put satisfaction/acceptance note on the report of demarcation presented by the kanoongo of area and the file of demarcation will be kept in record within 15 days.
